Mental Capacity Act
The Mental Capacity Act came into force in April 2007. The act protects people over 16 who need assistance in making decisions, due to mental capacity, about things like finances, social care, medical treatments and taking part in research.
From October 2007, more safeguards will enable individuals with mental capacity issues to plan ahead by making ‘Advance Decisions,’ and nominate someone to look after their financial affairs, or make health and welfare decisions on their behalf.
The Mental Capacity Act introduced the new statutory role of the Independent Mental Capacity Advocate (IMCA) to support people who lack capacity to make certain decisions.

What's Happening in Leicestershire?
A Mental Capacity Act Local Implementation Network (LIN) has been established.
Overall aim: To lead implementation of the Mental Capacity Act in Leicester, Leicestershire and Rutland ensuring good practice and a coherent approach across organisations.
The MCA LIN has a wide membership, which includes representation from the Voluntary Sector as follows:
